The Judiciary: Its Role and Jurisdiction

The Constitutional Law credential documents competencies including knowledge of the U.S. Constitution’s creation of facilities and structures for the separation of powers, allocation of powers between federal and state government, judicial review, congressional authority, presidential and agency powers, and protections of individual rights. Though many of these positions require appropriate education at various levels and additional training, a fundamental understanding of constitutional law provides a foundation that supports many aspects of daily tasks and decision-making. Specifically, this badge demonstrates the earner's ability to explain the structure of the federal courts, the jurisdictions of federal and state courts and factors that influence judicial decision-making, including primary methods for interpreting the Constitution, stare decisis and canons of construction.
